Mark did a great job representing me and got me a great outcome in my case. He represented me for driving under suspension and a speeding ticket. My driving record is not good and I was unaware that I was suspended. I was able to get my license reinstated and Mark got the driving under suspension charge dismissed. He also got the speeding ticket changed to a non-moving violation with a minimal fine which kept more points off my driving record. I also need to do 16 hours of community service. But that is fine by me because my license wasn't suspended again or revoked! Thanks Mark!

Glenwood Springs Hit-and-Run Lawyer Explains Colorado’s Hit-and-Run Laws and Penalties

Colorado’s hit-and-run law is strict. The law requires you to remain at the scene even if you were not at fault for the crash—if the crash caused property damage, bodily injury, serious bodily injury, or death. You have other duties as a motorist involved in an accident as well.

As a driver in Colorado, the law says that you must stop at an accident scene immediately. If you cannot immediately stop because it is unsafe, you must return to the scene and stay there until you have fulfilled your legal obligations.

What are the legal requirements for a person involved in an accident? You have a legal duty to notify the other people involved in the crash of your name, license number, address, and registration number of the vehicle you are driving. You also have to help the injured to the extent that you can.

You must report the crash to the police when the collision results in property damage, personal injuries, or death. Finally, the officers could ask you to write a supplemental accident report if they need additional information from you.

Why You Need a Glenwood Springs Hit-and-Run Attorney for Your Defense

Colorado law calls for stiff penalties for hit-and-run charges. The severity of the penalty depends on the facts of your case. For instance, leaving the scene of an accident involving property damage is a class 2 traffic misdemeanor. The penalty is 10 to 90 days in jail. But a hit and run causing an injury is a class 1 traffic misdemeanor that carries up to 1 year in jail.

You face felony charges if someone suffers serious injuries or dies. A hit-and-run crash with serious injuries is a class 4 felony, and hit-and-run crashes where someone dies are a class 3 felony. Class 4 felonies carry between 2 and 6 years in prison. Class 3 felonies carry between 4 and 12 years in prison.

You will need an experienced, skilled, and dedicated Glenwood Springs hit-and-run lawyer to fight for you. Call us today to learn more.

Colorado Assault Law

What Is 2nd-Degree Assault in Garfield County, Colorado?

If you intentionally or recklessly cause injury to another person with a deadly weapon, you could face second-degree assault charges. Second-degree assault is a grave crime with steep penalties. The only factor that separates second-degree from first-degree is that first-degree results in severe injuries to the victim.

The penalty for second-degree assault in Colorado can be monumental. Because second-degree assault is a violent crime, you could face a mandatory prison sentence of 2 to 16 years if convicted. The court could also impose a fine of up to $500,000. A second-degree assault conviction is something you want to avoid at all costs. Hiring a Glenwood Springs criminal defense attorney is your best defense against assault in Colorado!

What Is 3rd-Degree Assault?

In Colorado, third-degree assault is generally classified as a class 1 misdemeanor. You could be charged with third-degree assault if you knowingly, recklessly, or with criminal negligence inflict bodily injury on someone. A third-degree assault is typically charged under negligent or reckless circumstances. For instance, if you throw an object at someone and it leaves a bruise, you might be charged with third-degree assault.

The penalty for third-degree assault in Colorado is less than for second or first-degree assault. However, because third-degree assault is considered an extraordinary risk crime, the punishment is still harsh. Upon conviction, third-degree assault is punishable by 18 to 24 months in jail and a fine of up to $1,000.

  • Bicycle accidents: According to NHTSA statistics, 48,000 bicyclists have been injured in traffic accidents in recent years, and 743 were killed.
  • Pedestrian accidents: Pedestrians are completely unprotected and vulnerable to serious injuries when hit by a 3,000-pound vehicle. Negligent drivers who seriously injure pedestrians may be held liable for the damage they cause.
  • Defective products: If you have been seriously injured or lost a loved one because of a defective product, we can help you pursue compensation from the manufacturer or other responsible parties.
