Experienced Colorado DUID Lawyer
Serving Aspen, Avon, Breckenridge, Carbondale, Glenwood Springs, Grand Junction, Montrose, and The Vail Valley.
In Colorado, if you are over the age of 21, it is legal for you to buy or use marijuana for recreational use. However, just as with drinking alcohol, it is illegal for you to have five nanograms or greater of THC (tetrahydrocannabinol — the active ingredient in marijuana) in your system while you are driving.
At the law offices of Mark S. Rubinstein, P.C., I have provided criminal defense services for more than 24 years. I have witnessed the laws change over the years. I adjust adeptly to the ever-changing laws and the ways in which my clients are impacted. If you have been charged with driving under the influence of drugs (DUID), contact me, a DUID attorney, to arrange a free initial consultation.
Marijuana Is Legal in Colorado But Driving Under the Influence of it Is Not
If convicted of DUID, you can face jail time, fines, driver’s license suspension, and other penalties. Colorado law has established a blood-level limit for someone driving while under the influence of marijuana. The individual cannot have a blood limit higher than five nanograms per millimeter of THC. As a DUID defense lawyer, I am well-versed in the problems that exist with the blood test, namely that THC produces metabolites that can be found in your blood hours after the effects of marijuana have worn off. While you may not be impaired while driving, the blood tests may suggest that you are.
In whatever way you ingested pot (smoking it or with an edible) if you get behind the wheel and drive, you could be pulled over. Law enforcement and prosecutors believe that marijuana inhibits coordination and reaction time, and you will be punished if convicted.
In addition to driving under the influence of marijuana, I handle DUID cases involving prescription drugs and other drugs.
